What FAB Capital is
FAB Capital is a technology-enabled debt marketplace and Lending Distribution Partner that connects SME businesses seeking growth capital with lending institutions. We facilitate introductions and application tracking — we are not a bank, not an NBFC, and not a lending institution. We do not originate loans, assume credit risk, or guarantee funding or loan approval.
Account registration
Businesses and lending partners must register and be reviewed before their account is activated. You agree to provide accurate information and to keep your account credentials confidential.
Account approval and rejection
We reserve the right to approve, reject, or suspend any account at our discretion, including for incomplete or inaccurate information.
No guarantee of funding
Being matched with a lending partner does not guarantee a loan offer, sanction, or specific terms. All lending decisions are made solely by the lending institution.
Accuracy of information
You are responsible for the accuracy of the financial information and documents you submit, and this is a continuing obligation for as long as your account is active — not just a one-time check at submission. Providing false or misleading information may result in account termination.
Platform availability
We aim to keep the platform available and reliable but do not guarantee uninterrupted access.
Limitation of liability
To the extent permitted by law, our total liability to you is capped at the platform fee you have paid, if any. We are not liable for indirect, incidental, or consequential damages arising from your use of the platform.
Indemnification
You agree to indemnify FAB Capital against claims arising from your misrepresentation, fraud, or breach of any regulatory obligation in connection with your use of the platform.
Governing law and dispute resolution
These Terms are governed exclusively by the laws of India. Disputes are resolved by arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Hyderabad, Telangana, before a sole arbitrator, conducted in English. Where arbitration does not apply, the courts at Hyderabad retain exclusive jurisdiction.
Changes to these terms
We may revise these terms from time to time, and updates take effect immediately upon posting. Continued use of the platform after a change constitutes acceptance of the updated terms.
